Silky Streams respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement.

Filing a DMCA Takedown Notice

If you believe that content on Silky Streams infringes your copyright, please submit a written notice containing the following:

A physical or electronic signature of the copyright owner or authorized agent
Identification of the copyrighted work claimed to have been infringed
Identification of the material that is claimed to be infringing, with sufficient information to locate the material (URLs, usernames, timestamps)
Your contact information (address, telephone number, email address)
A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner

Counter-Notification

If you believe your content was removed in error or that you have authorization to use the material, you may file a counter-notification containing:

Your physical or electronic signature
Identification of the material that has been removed and its original location
A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
Your name, address, telephone number, and email address
A statement that you consent to the jurisdiction of the Federal District Court for your judicial district and will accept service of process from the complainant

Repeat Infringers

In accordance with DMCA requirements, Silky Streams will terminate the accounts of users who are determined to be repeat infringers. A repeat infringer is a user who has been notified of infringing activity multiple times and/or has had content removed multiple times.

Misrepresentation

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees.

Processing Time

Upon receipt of a valid DMCA notice, we will:

Remove or disable access to the allegedly infringing material within 24-48 hours
Notify the content uploader of the removal
Provide the uploader with information about filing a counter-notification
If a valid counter-notification is received, we may restore the content after 10-14 business days unless the copyright owner files a court action
